TERMS AND CONDITIONS

Welcome to LevelUpWithTimothy. By engaging our services (including but not limited to Website Design, Sales Funnel Architecture, GoHighLevel Automation, and Consulting), you (“The Client”) agree to be bound by the following Terms and Conditions.
1. Services & Scope of Work
1.1 Nature of Services: LevelUpWithTimothy provides “done-for-you” digital marketing systems, including funnel design, website development, CRM setup (GoHighLevel), and automation workflows.
1.2 Scope Definition: The specific deliverables for your project will be outlined in your proposal, invoice, or service agreement. Any work requested outside of this defined scope will be subject to a separate quote and billing.
1.3 Platform Independence: LevelUpWithTimothy is an independent service provider and is not an employee, agent, or affiliate of GoHighLevel (HighLevel, Inc.), Facebook (Meta), or Google.
2. Payment Terms & Refunds
2.1 Payment Schedule: Unless otherwise agreed in writing, a non-refundable deposit (typically 50%) is required to secure your slot in our calendar. The remaining balance is due upon project completion or before the final transfer of assets.
2.2 No Refunds: Due to the nature of digital services and the time invested in strategy and design, all payments are non-refundable once work has commenced.
2.3 Late Payments: Failure to pay the final invoice within 7 days of project completion may result in a temporary suspension of services or the withholding of final asset transfer.
3. Client Responsibilities & Software Costs
3.1 Third-Party Subscriptions: The Client is responsible for all third-party software costs required to run the systems we build. This includes, but is not limited to, GoHighLevel (GHL) subscriptions, domain hosting, email providers (e.g., Mailgun/LC Email), and SMS costs (Twilio). LevelUpWithTimothy is not responsible for paying your software bills.
3.2 Content & Assets: The Client agrees to provide all necessary copy, images, branding assets, and login credentials in a timely manner.
3.3 The “Ghosting” Clause: If the Client fails to provide feedback or assets for more than 14 consecutive days, the project will be placed on hold. A re-activation fee may be required to resume work, subject to current calendar availability.
4. Revisions & Approvals
4.1 Revision Rounds: Our standard packages include two (2) rounds of revisions per deliverable (e.g., per page or per workflow).
4.2 Scope Creep: A “revision” is defined as a tweak to the existing design or copy (e.g., “change this color,” “swap this photo”). A request to create a completely new design or add a new funnel step that was not in the original agreement is considered a “Change Order” and will be billed additionally.
5. Earnings & Results Disclaimer
5.1 No Guarantees: While LevelUpWithTimothy builds high-quality, conversion-focused systems based on industry best practices, we cannot and do not guarantee specific financial results, lead volumes, or revenue.
5.2 Marketing Variables: Your success depends on variables outside our control, including your ad spend, traffic quality, product offer, market demand, and sales skills. We build the “car,” but you are responsible for “driving” it.
6. Intellectual Property (IP)
6.1 Ownership: Upon full payment of the final invoice, the Client is granted full ownership of the funnels, websites, and automations created for them.
6.2 Portfolio Rights: LevelUpWithTimothy retains the right to display the completed work (screenshots, links, or case studies) in our personal portfolio and marketing materials for self-promotional purposes.
7. Liability & Indemnification
7.1 Platform Changes: LevelUpWithTimothy is not liable for disruptions caused by third-party platform updates (e.g., a GoHighLevel update, a Facebook API change, or an email delivery issue).
7.2 Limitation of Liability: In no event shall LevelUpWithTimothy be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from the use of the services provided.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under this agreement shall be resolved in the jurisdiction of Nigeria.
